TERMS AND CONDITIONS
for the provision of services within an artistic photography program
1. General Provisions
1.1. This document constitutes a public offer (hereinafter the „Offer“) to conclude a contract for the provision of services within an artistic photography program.
1.2. The Provider is Anna Fast FotoArt, operating in the Federal Republic of Germany.
1.3. The Client is a natural person who accepts this Offer.
1.4. Acceptance of the Offer is deemed to occur upon full payment for the selected participation service.
1.5. Upon acceptance, a contract is concluded between the Provider and the Client.
2. Subject of the Contract
2.1. The Provider delivers services within an artistic photography program (hereinafter the „Services“), including:
— photographic shooting
— selection and recommendation of photo locations
— informational support within the program
2.2. The Services are of an artistic and advisory nature.
2.3. The Provider does not provide travel services and does not act as a tour operator.
2.4. This contract does not constitute a package travel agreement within the meaning of applicable law.
2.5. The Services do not include:
— accommodation
— transportation
— meals
— entrance tickets
— any third-party services
2.6. Such services are independently arranged and paid for by the Client with third parties.
2.7. The Provider does not arrange, sell, or mediate accommodation, transport, or any other third-party services.
2.8. The Provider delivers an independent service and does not combine tourist services within the meaning of applicable regulations.
3. Provision of Services
3.1. The Services are provided on the dates and at the locations specified on the website or otherwise agreed with the Client.
3.2. The format of the Services (group or individual) is determined by the selected service and specified on the website or agreed separately.
3.3. The Provider reserves the right to make reasonable changes to the program content or schedule, provided this does not materially affect the overall nature and quality of the Services.
3.4. The Client independently and at their own expense arranges travel to and from the program location.
3.5. The Provider does not organize or coordinate transportation or logistics for the Client.
4. Prices and Payment Terms
4.1. Prices are indicated on the website or agreed individually.
4.2. A place is considered booked only after full payment has been made.
4.3. Full payment must be made no later than the booking deadline specified on the website.
4.4. If full payment is not made by the deadline, the Provider reserves the right to refuse service without reserving the place.
5. Minimum Group Size
5.1. The program is conducted only if the minimum number of participants specified on the website is reached.
5.2. If the minimum number is not reached, the Provider may cancel the program.
5.3. In such a case, all payments made will be refunded in full.
5.4. Refunds are processed within 10 business days from the decision to cancel the program.
6. Client Cancellation
6.1. The Client may withdraw from the contract before the start of the program.
6.2. The following refund conditions apply:
— before the booking deadline: 100% refund
— after the booking deadline: 70% refund of the paid amount
6.3. The retained amount is justified by incurred and planned organizational expenses of the Provider.
6.4. Refunds are processed within 10 business days after confirmation of the cancellation.
7. Liability
7.1. The Provider is liable only for the proper provision of the Services described in Section 2.
7.2. The Provider is not liable for:
— services of third parties
— accommodation and its quality
— transportation and its availability
— delays, cancellations, or changes in transportation
— actions of third parties
— any indirect losses of the Client
— inability to use services purchased by the Client from third parties
7.3. The Client is solely responsible for:
— arriving on time at the meeting point
— booking accommodation and transportation
— possessing all required documents, visas, and permits
7.4. The Client independently makes all decisions related to the trip and bears full responsibility for them.
8. Force Majeure
8.1. The Provider is not liable for failure or delay in performance due to force majeure circumstances.
8.2. Such circumstances include, but are not limited to:
— weather conditions
— travel restrictions
— actions of governmental authorities
— strikes
— disruptions in transportation
8.3. In such cases, the timing of services may be adjusted accordingly.
9. Final Provisions
9.1. Payment for the Services constitutes full and unconditional acceptance of these Terms.
9.2. The laws of the Federal Republic of Germany shall apply.
9.3. If any provision is found to be invalid, the remaining provisions shall remain in force.

Additional Conditions
11. Online Contract Conclusion
11.1. The contract is concluded remotely.
11.2. The Client confirms that they have reviewed these Terms prior to acceptance.
11.3. The Client confirms that they understand and voluntarily accept these Terms.
12. Health and Personal Responsibility
12.1. The Client confirms that they are physically and mentally able to participate in the program.
12.2. The Client bears full responsibility for their health during participation.
12.3. The Provider is not liable for any health-related issues arising during participation.
12.4. The Client is responsible for assessing weather conditions and physical demands.
13. Use of Images
13.1. The Provider is entitled to use photographs created during the program for portfolio, website, social media, and promotional purposes.
13.2. Such use will not include personal data unless otherwise agreed.
13.3. The Client may prohibit the use of images by notifying the Provider before the start of the program.
13.4. In case of withdrawal of consent after publication, the Provider shall cease further use within a reasonable time, while already published materials may remain.
14. Communication
14.1. All essential information is provided via the contact details supplied by the Client.
14.2. The Client is responsible for monitoring such communications.
15. Client Conduct
15.1. The Client must behave appropriately and must not interfere with the program or the Provider’s work.
15.2. Violations include, but are not limited to:
— aggressive or offensive behavior
— ignoring instructions from the Provider
— actions endangering oneself or others
— repeated disruption of the program
15.3. In case of serious violations, the Provider has the right to terminate the Services without refund.
16. Language Versions
16.1. These Terms are available in German, Russian, and English.
16.2. The Russian version shall prevail for interpretation, provided the Client understands Russian.
16.3. The German and English versions are provided for informational purposes only.
16.4. In case of discrepancies, the Russian version shall prevail to the extent permitted by law.
